Biometric Data Policy

SafelyStay, Inc., (“Safely”, “our”, “we” and “us”) has instituted the following policy related to any Biometric Data collected and/or stored by Safely or its vendors/service providers in connection with our operations or our clients’ and client customers’ use of our products and services.

Biometric Data Defined

“Biometric identifier” means a retina or iris scan, fingerprint, voiceprint, or a record or scan of hand or face geometry and any other data generated by automatic measurements of an individual’s unique biological characteristics or patterns used to identify a specific individual. “Biometric information” means any information, regardless of how it is captured, converted, stored, or shared, based on an individual’s biometric identifier used to identify an individual. As used in this policy, “Biometric Data” includes “biometric identifiers” and “biometric information” as defined applicable law.

Purpose for Collection of Biometric Data

Safely, its vendors, and/or service providers may collect, store, and use your facial geometry for purposes of identification and fraud prevention.

Disclosure

Your Biometric Data will not be disclosed or disseminated beyond Safely, its vendors and/or service providers unless:

  • you consent;
  • the disclosure or dissemination completes a financial transaction requested or authorized by the subject of the biometric data or the subject’s legally authorized representative;
  • the disclosure or dissemination is required by State or federal law or municipal ordinance; or
  • the disclosure is required pursuant to a valid warrant or subpoena issued by a court of competent jurisdiction.

Retention Schedule

Safely, its vendors, and/or service providers will retain your Biometric Data only until the first of the following occurs and thereafter it will be permanently destroyed:

Safely receives written notice from its client or its client’s customer that the initial purpose for collecting or obtaining the Biometric Data has been satisfied

  • 3 years has passed since your last interaction with Safely and/or its vendors/service providers

Data Storage

Safely and its vendors/service providers shall use a reasonable standard of care to store, transmit, and protect from disclosure any Biometric Data collected. Such storage, transmission, and protection from disclosure shall be performed in a manner that is the same as or more protective than the manner in which they store, transmit, and protect from disclosure other confidential and sensitive information.
